  1. Acceptance of our Terms
    • The website nccuk.com (the “Site”) is owned and operated by NCC Operations Limited a company registered in England and Wales and under Company Number 07304890, whose registered office is at Feynman Way, Bristol and Bath Science Park, Emersons Green, Bristol, BS16 7FS, England (“NCC”). Our VAT registration number is GB: 991 261 800. In these terms, ‘we’, ‘us’ and ‘our’ refer to NCC.
    • By visiting, viewing, accessing or otherwise using any of the services or information created, collected, complied or submitted to www.nccuk.com, you provide full acceptance of these terms, our Privacy Notice and our Cookies Policy in full (known collectively as “our Terms”). Our Terms constitute a legally binding agreement between you and NCC and your continued use of the Site shall indicate your conclusive acceptance of our Terms. If you do not agree to be bound by and comply with all of the foregoing, you must not access or use the Site.
    • If you order any goods, services or digital content from the Site, separate terms and conditions will apply.
  2. Use of the Site
    • You may only use the Site for lawful purposes.
    • You agree that you are solely responsible for all costs and expenses you may incur in relation to your use of the Site.
    • We make no promise that the Site is appropriate or available for use in locations outside of the UK. If you choose to access the Site from locations outside the UK, you acknowledge you do so at your own initiative and are responsible for compliance with local laws where they apply.
    • You may not use the Site:
  • in any way that breaches any applicable local, national or international law or regulation;
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • for the purpose of harming or attempting to harm other users in any way;
  • to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or
  • to knowingly transmit any data, send or upload any material that contains viruses or any other harmful programs or anything designed to adversely affect the operation of software or hardware.
    • You shall not:
  • transmit through or to the Site any content that:
    • is unlawful, abusive, threatening, harmful, obscene, lewd, offensive, defamatory or otherwise objectionable; or
    • might infringe the intellectual property rights, privacy rights, rights of publicity, or other proprietary rights of others;
  • disrupt, place unreasonable burdens or excessive loads on, interfere with or attempt to gain unauthorized access to any portion of the Site, computer systems, servers or networks;
  • provide false information about yourself to us, impersonate any other person, or otherwise attempt to mislead others about your identity or the origin of any content, message or other communication;
  • try to collect information about other visitors to the Site without their consent or otherwise systematically extract data or data fields, including without limitation any financial data or e-mail addresses;
  • sell access to or the use of the Site, including any content contained on, downloaded or accessed from the Site; or
  • redistribute any content, including data, made available by us on the Site.
  1. Proprietary Rights
    • The intellectual property rights in the Site and in any text, images, video, audio or other multimedia content, software or other information or material submitted to or accessible from the Site (“Content”) are owned by us and our licensors.
    • We and our licensors reserve all our intellectual property rights (including, but not limited to, all copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind) whether registered or unregistered anywhere in the world. This means, for example, that we remain owners of them and are free to use them as we see fit.
    • Nothing in these Terms grants you any legal rights in the Site or the Content other than as necessary for you to access it. You agree not to adjust, try to circumvent or delete any notices contained on the Site or the Content (including any intellectual property notices) and in particular, in any digital rights or other security technology embedded or contained within the Site or the Content.
    • To the greatest extent permissible by law, all use or copying of the Site and any Content on the Site, other than as expressly permitted by NCC, is prohibited. You may not, transmit or store website content in any other website or other form of electronic retrieval system.
  2. Linking to the Site
    • Linking to the Site is allowed provided you have informed NCC in advance of linking and any link to the Site is to the home page or landing page. Deep linking is not allowed. NCC reserves the right to deny or withdraw permission to link where it, in its sole opinion, considers the link is detrimental to NCC, its business or its partners.
    • If you intend to Link to the Site or would like to obtain permission to make use of material from the Site, please contact [email protected].
  3. Rights to information published
    • By submitting Content to the Site (including any text, photographs, graphics, video or audio) you grant NCC an irrevocable, perpetual, worldwide, royalty free licence to use the material in any way we want (including publishing, modifying, distributing and deleting it). In order that we can use your contribution, you confirm that your contribution is your own original work, is not defamatory and does not infringe any UK laws and that you have the right to give us permission to use it for the purposes specified above.
    • Other than any personal information which will be dealt with in accordance with our Privacy Notice (see below), we do not guarantee that information supplied to us through the Site will be kept confidential and we may use it on an unrestricted and free-of-charge basis as we reasonably see fit.
  4. Disclaimer of Warranties
    • The information contained in the Site is for general information purposes only, does not amount to advice and should not be relied on as such. It does not constitute technical, financial or legal advice or any other type of advice and should not be relied on for any purposes. You should always use your own independent judgment when using our Site and its Content.
    • While we endeavour to keep the information on the Site up to date and correct we make no express or implied warranties, representations or undertakings whatsoever in relation to any of the content (including the accuracy, quality or fitness for any purpose of the content). You understand and agree that your use of the Site is entirely at your own risk and that it is provided on an “as is” and “as available” basis. We may suspend or terminate access or operation of the Site at any time as we see fit.
  5. Our responsibility for loss or damage suffered by you
    • With the exception of any liability which by law cannot be excluded, NCC, its officers, employees, contractors and content providers shall in no event be liable for any loss or damage suffered as a result of the use of the Site or the information contained herein, even if it is foreseeable.
    • We are not liable to you if we fail to comply with these terms because of circumstances beyond our reasonable control.
  6. Limiting liability for viruses, damage and availability
    • Every effort is made to keep the Site up and running smoothly. However, NCC does not warrant that functions available on the Site will be uninterrupted or error free, that defects will be corrected, or that the Site and Content are free of viruses or bugs. NCC takes no responsibility for, and will not be liable for, the Site being unavailable due to technical issues.
    • It is your responsibility as a website user to implement sufficient procedures and virus checks (including anti-virus and other security checks). Specialist or technical advice should be sought in relation to any particular circumstance or problem.
  7. Cyber Crime
    • You must not misuse the Site in any way including in any illegal or criminal way; in any way which could give rise to civil liability; or in any way which would be technically harmful to the Site. In particular you must not misuse the Site by knowingly introducing viruses, worms, or other material which is malicious or technologically harmful, nor attempt to carry out any denial-of-service attack or a distributed denial-of service attack. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site.
    • Any breach this provision likely constitutes a criminal offence, and we will report any such breach to the relevant law enforcement authorities. In the event of such a breach, your right to use the Site will cease immediately.
    • To the extent permissible by law, we will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any material posted on it, or on any website linked to or within it. You agree not to use the Site, its facilities or any information contained on it to facilitate the distribution of unsolicited emails to any person.

Through the Site you may be able to navigate to other websites which are not under the control of NCC. We provide these for convenience and information only. We have no control over the nature, content and availability of those sites (including advertising), and accept no legal responsibility for any content, material or information contained in them. The inclusion of any links does not imply a recommendation or endorse the views expressed within them.

  1. Legal jurisdiction and Severability
    • The laws of England shall govern these terms and your use of the Site and you hereby agree to submit to the exclusive jurisdiction of the English courts to resolve any legal matter arising from these terms, the agreement between you and us or related to your use of the Site.
    • If any wording in any provision of these terms of use is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable it shall, to the extent of such illegality, invalidity, voidness, voidability, unenforceability or unreasonableness, be deemed severable and the remainder of such provision and the remaining provisions of these terms shall continue in full force and effect.
  2. Your Statutory Rights

If you are a consumer, nothing in our Terms shall be deemed to restrict or affect any of your statutory rights under English Law to the extent that they are applicable to your use of the Site and to our Terms.
